Terms

• Wherever in this document the word "we" or "VariSearch" is used, it refers to VariSearch website management. 
• Wherever in this document the work "Web Site" or "Site" is used, it refers to the website being submitted for listing
• Wherever in this document the word "you" is used, it refers to the person submitting the website information, and to the website being submitted for listing.
• In the event a person not related to, or responsible for the Web Site submits a form, the Web Site may have its listing removed or amended, within the scope of this agreement, by putting a request in an email to badentry@varisearch.com Note that you must use an email address AT the website being described, or the exact email address used during submission, for this message to be acted upon.

Acceptance of Agreement

By submitting your website listing you agree to the Terms and Conditions in this document, and agree to provide complete and accurate information about your website to us.

VariSearch reserves the right to alter or amend this agreement at any time, and to place the amendment at this same location (http://www.varisearch.com/Webmasters/TermsandConditions.shtm)

Description of Service

A VariSearch basic listing is a free service provided by VariSearch to list your website in an appropriate category on our search engine directory.  Basic listings have no expiration date, and do not incur a charge in any way.

A VariSearch enhanced listing is a link-exchange service, allowing the site to improve the appearance of its listing by adding either a graphic site logo, or additional qualifying categories to describe the site.  This service is provided in exchange for an active link to VariSearch, using one of our graphic or text ads.  Your listing will be enhanced as long as the basic listing is still valid, and the link to our site remains on your site.  Additional enhancements may be purchased for a fee.  See the Advertiser's Section for more information.

Submission of a Website does not guarantee inclusion in our list.  Inclusion is limited to sites that meet the "Site Criteria"  outlined in the section below.

Conditions - Site Criteria

VariSearch will reject any submission for any site that is deemed to include services, products or content that are:

• Pornographic, containing Adult Content, Obscenities, or "x-rated"
• Defamatory, Libelous, Inflammatory, Offensive, or Promoting Hatred
• Illegal, such as violation of a third-party's copyright or trademark
• Promoting illegal activities, such as hacking, spamming, phreaking, phishing
• Deemed unacceptable for other reasons, as determined by one of our staff

Site Listings

VariSearch reserves the right to determine when the listing will first appear.

VariSearch reserves the right to edit the description content for accuracy.

VariSearch reserves the right to change the category selection for a website, if we find the selection provided to not accurately represent what the website provides.

Conditions of Use

By using this service, you agree that you will not attempt to undermine the integrity, appearance, or reputation of our site.

Limitation of Liability and Warranty

You agree that use of the service is entirely at the user's own risk.  Services are provided "as is", without warranty of any kind, expressed or implied.  This includes without limitation any warranty for Information, Services, Uninterrupted access, or products provided through or in connection with our service.  This also include without limitation the results obtained through our service.  We disclaim any warranties concerning the availability, accuracy, or content of information, products or services.  We disclaim any warranties of Merchantability or Fitness for a particular purpose.

This disclaimer applies to any damages or injury caused by any failure of performance, error, omission, deletion, delay of any kind, computer virus, theft or destruction, negligence, unauthorized access to our site, or any other cause of action.  You acknowledge that VariSearch is not liable for defamatory, offensive or illegal conduct of other customers or third parties, and that the risk of injury rests entirely with you.

Neither VariSearch, nor any of its agents, affiliates, or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of our services, or inability to gain access to or use our services, or out of any breach of any warranty.  Customer acknowledges that the provisions in this section apply to all content on the VariSearch site.

Information presented by VariSearch, regardless of the mode of communication (web, wireless, email) is copyright of VariSearch, and Richard F. Parker.  We place no claim on websites that are listed, but we treat the information as we present it as copyrighted material.
